Sales regulations kept by the Seller via the Garage Makezone service

§ 1 Initial provisions

1. These regulations define the rules of sale conducted by the Seller via the Garage Makezone service.

§ 2 Definitions

1. Website - this online trading platform is available on-line at https://sklep.garage-makezone.eu, through which the Seller sells the goods.

2. Regulations - these regulations.

3. Business days - days from Monday to Friday, excluding public holidays.

4. Consumer - Consumer within the meaning of the Civil Code.

5. Buyer - every entity purchasing from the Seller via the Website.

6. Offer - proposal to conclude a contract for the sale of goods on terms specified by the Seller, in particular containing the price and description of the offered goods, presented in a manner accepted on the Website.

7. Entrepreneur - Buyer who is not a Consumer.

8. Seller - SYLWIA MATUSZEWSKA, an entrepreneur running a business under the name Garage Makezone Matuszewska Sylwia, entered into the Central Register and Information on Economic Activity conducted by the Minister of Development and Finance, NIP number 6981410573, REGON number 411422183, ul. Maria Konopnicka 30, 62-404 Ciążeń, appearing on the Website under the name Garage_Makezone.

§ 4 The cost of the order

1. Prices given in the description of the goods on the Website include VAT.

2. The total cost of the order consists of the price for the goods and the cost of delivery indicated in the Offer.

§ 5 Payments

1. The entity providing online payment services by electronic means is Blue Media SA.

2. Available payment methods that can be used for payment:

    - Shoper payments

    - Visa

    - Visa Electron

    - MasterCard

    - MasterCard Electronic

    - Maestro

3. If there is a need to return funds for the transaction made by the customer with a payment card, the seller will return the money to the bank account assigned to the payment card of the Ordering Party.

 

§ 6 Execution of the accepted order

1. The goods are delivered exclusively on the territory of the Republic of Poland, unless the Offer specifies otherwise, through: a. InPost parcel machines

2. The term of the contract is indicated in the store.

3. The deadline for completing the order is counted from the date of the contract of sale, subject to paragraph 5.

4. The dates indicated by the Seller shall apply to Business Days, both the preparation of goods for dispatch and their dispatch shall take place on Business Days.

5. If the sales contract includes several goods, the shipment will be sent by the Seller after completing the entire order - ie at the latest at the time of completion appropriate for the ordered goods with the longest deadline for sending the order.

6. If the Buyer selects payment in advance for the order, the Seller will proceed with the order after receiving payment for it.

7. The seller is obliged to deliver goods without defects.

§ 7 Withdrawal from the contract (return of goods) (the right only for Consumers)

1. The consumer has the right to withdraw from the contract for the sale of goods, subject to § 8 of the Regulations, within 14 days without giving any reason. This right is not available to the Entrepreneur. 2. The deadline to withdraw from the contract expires after 14 days, from: a. In which the Consumer came into possession of the goods or in which a third party other than the carrier and indicated by the Consumer became the owner of the goods; b. in which the Consumer came into possession of the last item or in which a third party other than the carrier and indicated by the Consumer acquired possession of the last item, in the case of a contract obliging to transfer ownership of many things, which are delivered separately. 3. In order for the Consumer to exercise his right to withdraw from the contract, he must inform the Seller, for example using the data provided in the Regulations, about his decision to withdraw from the sales agreement by way of an unambiguous statement (for example, a letter sent by mail or information sent by e-mail). 4. In order to keep the deadline for withdrawing from the contract, the Consumer should send information regarding the exercise of his right to withdraw from the contract before the deadline to withdraw from the contract. 5. In the event of withdrawal from the contract of sale, the Seller shall return to the Consumer all payments received from him, subject to paragraph 7, immediately, and in any case not later than 14 days from the date on which the Seller was informed by the Consumer about his withdrawal from the sales contract. 6. The Seller returns to the Consumer only the cost of delivery of the goods to the Consumer, in the amount corresponding to the cheapest, ordinary, available in the Offer method of delivery of goods. 7. The direct costs of returning the returned goods to the Seller shall be borne by the Consumer. 8. If the goods, due to their nature (eg due to their size) can not be sent back in the usual way by post, the consumer will also have to bear the direct cost of returning the goods. The amount of these costs will be estimated in the Offer. 9. The reimbursement shall be made by the Seller using the same payment methods that were used by the Consumer in the original transaction, unless the Consumer agrees to a different solution. In any case, the Consumer will not incur any fees in connection with this refund. 10. The seller may withhold the return of the payment until receipt of the goods or until proof of his return has been provided to him, depending on which event occurs first. 11. The Seller asks to return the goods to the following address: 61-008 Poznań Smolna 13B / 166 immediately, and in any case not later than 14 days from the date on which the Consumer informed the Seller about the withdrawal from the sales contract. 12. The consumer is only liable for a decrease in the value of the goods resulting from using it in a different way than was necessary to establish the nature, characteristics and functioning of the item.

§ 8 No right to withdraw from the contract

1. The right to withdraw from a distance contract is not entitled to the Consumer in relation to the contract: a. In which the subject of the service is a non-prefabricated product, manufactured according to the consumer's specification or serving to satisfy his individual needs. b. In which the object of the service is an item subject to rapid deterioration or having a short shelf-life. c. In which the object of the service is an item delivered in a sealed package, which after opening the packaging can not be returned due to health protection or hygiene reasons, if the packaging was opened after delivery. d. In which the subject of the service are things that after delivery, due to their nature, are inseparably connected with other things. e. In which the subject of the service are sound or visual recordings or computer software delivered in a sealed package, if the packaging has been opened after delivery. f. For the delivery of newspapers, periodicals or magazines, with the exception of a subscription agreement. g. In which the price or remuneration depends on fluctuations in the financial market, over which the entrepreneur has no control, and which may occur before the deadline to withdraw from the contract. h. For delivery of digital content that is not recorded on a tangible medium, if the fulfillment of the service started with the consumer's express consent before the deadline to withdraw from the contract and after informing the entrepreneur about the loss of the right to withdraw from the contract.

§ 9 Complaints

1. In the event of a defect of goods, the buyer has the opportunity to advertise the defective goods based on the warranty regulated by the Civil Code. 2. Using the warranty, the Buyer may, on the terms and in the deadlines specified in the Civil Code: a. Submit a price reduction statement. b. With a material defect - submit a statement of withdrawal from the contract. c. Demand for the replacement of things to be free of defects. d. Request removal of the defect. 3. The Seller asks for a complaint based on an electronic warranty or in writing to the appropriate address indicated in § 3 of the Regulations. 4. In order to consider a complaint lodged on the basis of a warranty, the Consumer, if necessary, is obliged, in the case of the Consumer at the expense of the Seller, to deliver the defective goods to the address 61-008 Poznań Smolna 13B / 166. 5. The Seller recommends that the complaint contains the following information: identification data of the Buyer, a brief description of the defect, the moment of finding the defect and the Buyer's claim for complaint. 6. Any recommendation of the Seller that is contained in the Regulations has only the nature of a non-binding indication from the Consumer, from which the Consumer may or may not take advantage. Consumer's failure to use the Seller's instructions does not affect the rights of the Consumer, in particular, and does not affect the rights related to the warranty. 7. The Seller will respond to the complaint within 14 days. EXTRAORDINARY WAYS OF SETTLING COMPLAINTS AND INVESTIGATING CLAIMS 8. In a situation when the complaint procedure does not bring the result expected by the Consumer, the Consumer may use, among others with: a. as a rule, free mediation carried out by the competent regional inspectorate of Trade Inspection, to which you should apply for mediation. As a rule, free assistance of the competent and permanent amicable consumer court operating at the Provincial Inspectorate of Trade Inspection, to which the application should be submitted for considering the case before the arbitration court. § 10 Personal data

1. The Seller of the Buyer's personal data provided to the Seller in connection with the purchase of the goods presented in the Offer is the Seller. 2. By making purchases, the Buyer provides his personal data voluntarily. However, providing personal data is necessary to complete the order. The personal data provided by the Buyer will be processed by the Seller only for the purposes referred to in this paragraph, unless the Buyer provides it to the Seller for a different purpose, based on separate arrangements of the Parties. 3. The buyer has the right to inspect personal data concerning him, as well as to request their correction.

§ 11 Final provisions

1. A sales contract concluded on the basis of these regulations concerns a specific and one-off order - it is concluded for the purpose and for the time of its implementation. 2. Regardless of the rights referred to in § 7 of the Regulations, each of the Parties to the contract has the right to withdraw from the contract in case of delay of the other party in fulfilling the obligation within the period specified in the sales contract without setting an additional deadline. This provision shall not prejudice the rights of the Consumer resulting from the provisions of law. 3. Contracts concluded on the basis of the Regulations are concluded in Polish.
